Website Privacy Statement

 1.0  Introduction

 

When you visit our websites (or subdomains) (the “Website”), contact us, enter into an agreement with us, we collect personal data from and about you. This Privacy Statement describes which personal data is collected and for which purposes this personal data is processed by AFI Europe N.V. and its subsidiaries ("AFI", "we", "our" or "us"). It also states which rights you have under applicable data protection law.

 

2.0  What personal data do we process about you?

 

Personal data is information, or any combination of separate pieces of information, that could be used to identify you. We may collect information about you from several sources. This includes information we collect directly from you when you contact us, information we collect when you visit our sites, a local branch, other property websites or when you enter into an agreement with us;

 

The types of Personal Data we collect from you will depend on the specific type of services and as requested by, or provided to, you. The types of Personal Data may include (without limitation) the following:

  1. Your personal information (e.g. your name, gender and date of birth);
  2. Your contact information (e.g. telephone numbers, mailing addresses, email addresses and fax numbers);
  3. Your business information (e.g. company name, business title and associated contact information);
  4. Information and documents necessary to carry out the process of identification and verification of your person in order to obtain certain and relevant information required for cooperation, in case of interest in using our services (e.g. bank statements, scans of employment contracts, civil law contracts, financial documentation, scans of identity documents, etc.).
  5. Interests, personal preferences or comments you may have provided to us;
  6. Information when you use our websites (e.g. location information, browser details, IP addresses).
  7. When you visit one of our properties, your image may be captured by a CCTV camera.

 

3.0  Ways we use your Personal Data

 

We will only use your personal data where we have a valid lawful basis to do so. The purposes for which your Personal Data are collected and used may include (without limitation) one or more of the following purposes:

 

  1. To enter into an agreement with you; In order to be able to enter into an agreement with you in person or with your company, we need your personal data. For example, to rent you an apartment or to engage in business relation with your company. When entering into an agreement, we may also ask you for a proof of your identity and make a copy thereof. In certain cases, provision of your personal data is voluntary, but necessary to enter into and perform the contract, support the cooperation and use our services, therefore failure to provide such data will result in our inability to perform the contract and other services.
  2. To cooperate with you; In the case you do not enter into a contract and you do not directly use our services (e.g. acting as an employee of our customer or supplier), provision of personal data may be required in the context of your official duty and result from our legitimate interest.
  3. To serve you well; If you rent an apartment or business space from us in one of our properties, we want to provide you with the best service. For this purpose, we need your contact details for operational purposes, such as payment administration or, for example, in the context of maintenance services. We also protect our properties by installing CCTV cameras which may capture your image or that of your guests.
  4. To keep you informed; personal data may be used to respond to your enquiries or complaints. With your consent, personal information may be used for marketing or promoting purposes (e.g. sending you updates on our latest offers and promotions in relation to any of our offerings from time to time);
  5. To abide laws and regulations; your personal data may be shared with relevant authorities when required by law, regulation, or court order of any jurisdiction and/or as requested by any government, regulatory or law enforcement authority or administrative organisation. Your information may be used for establishing legal claims or defenses, obtaining legal advice, and/or exercising, defending and/or protecting the legitimate rights of AFI and its properties.

 

4.0  How long do we keep your personal data?

 

We will retain Personal Data for the period necessary to fulfil the purposes outlined in herein, unless a longer retention period is required or permitted by law. If you rent a property from us we will keep your personal data for as long as you remain our tenant and thereafter as required by law.

 

5.0  Who we may share your personal data with?

 

We engage third-party service providers to perform a variety of business operations on our behalf. In doing so, we may share your personal data with them. We provide our service providers with only the personal data they need in order to perform the services we request, and we contractually require that they protect this information appropriately and not use it for any other purpose.

 

We may also share your personal data to other external entities, in particular to entities cooperating with the us in the performance of contracts, implementation of the services and supporting our activities (such as banks, entities providing accounting services, advisory, IT, subcontractors, suppliers), wholly owned subsidiaries, as well as state authorities or other entities authorized by law.

 

We may transfer your Personal Data to recipients in countries other than the country in which the information originally was collected, including outside of the European Economic Area (EEA). Those countries may not have the same data protection laws as the country in which you initially provided the information, however when we transfer or store your personal data outside of the EEA we will ensure to that adequate measures are in place to protect your personal data to an equivalent standard of protection as in the EEA.

 

6.0  How do we protect your personal data

 

When you provide us with your Personal Data, we will process it using our systems, meaning your details will be inputted into our secure databases. We have appropriate security measures in place to help ensure that your data is not lost, stolen, accessed by unauthorised third parties, or tampered with in any way. Internally, your personal data will only be accessible by those members of our staff that have a need to see your data (which will depend on the nature of the services we are providing to you). However, we cannot guarantee your personal data will be free from every security risk that may be possible when your information is sent to and from the website or the app.

 

7.0  Children’s Privacy

 

Our services and website are not directed to children under the age of thirteen and we do not knowingly collect Personal Data from children under the age of thirteen.

 

8.0  Processing by automated means  

 

Your personal data will not be processed by automated means, including in the form of profiling, so that as a result of such automated processing, any decisions could be made, other legal effects may be caused or in any other way it would have a significant impact on you.

 

9.0  Use of Cookies and Log Files

 

If you visit any of our websites, we may use cookie files to store and track information about you and your preferences. A cookie is a small text file that our website transfers to your computer or mobile device. We use performance and analytical cookies; These cookies collect aggregated data on how visitors interact with the website, including, but not limited to the number of visitors, pages or links accessed and length of time spent on the website or specific page. Cookies may also be used to allow the website to remember choices you have made in previous sessions.

 

On your first visit to our website, we will inform you about the type of cookies we use and ask for permission to place them. Some browser may automatically accept cookies on your behalf, in such case you can edit your browser options to block them in future.

 

If you use the WiFi available at our properties, we may collect your location data (if you have consented to this on your device). We may use your location data to keep track of your activity patterns and preferences in order to improve the level of service you receive.

 

10.0  Social Media             

 

If you interact with us on social media platforms (for example if you "follow" our LinkedIn Page or post on our timeline), we can interact with you and send you messages via these platforms. We will interact with you in accordance with the social media platform's rules but we are not responsible for how the platform operators collect and handle your Personal Data. We are not responsible for what third parties post on our social media accounts.

 

11.0  Your privacy rights  

 

You have the right to inspect, correct or delete your personal data. You can also object to the use of your data. You also have the right to submit a complaint to the Dutch Data Protection Authority, however we would appreciate if you approach us first and allow us with the chance to respond to your query.

In addition, you have the right to withdraw, at any time, your consent to the processing of your personal data.

When you contact us to exercise your rights as a Data Subject we may need to ask you for specific information to help us confirm your identity and to ensure we can satisfy your request. This is a security measure to ensure your personal data is not disclosed to anyone who is not entitled to receive it. We aim to respond to all requests within one month. Occasionally it may take us longer than a month to respond, if your request is particularly complex or you have made a number of requests; we will let you know within the month if this is the case and will keep you updated on our response time.
